1、工程合同中的安全施工与环境保护条款中英文对照版工程合同中的安全施工与环境保护条款（中英文对照）SAFETYATWORK,ORDERLYCONDUCTANDENVIRONMENTALPROTECTION合同履行期间，合同当事人均应当遵守国家和工程所在地有关安全生产的要求，合同当事人有特别要求的，应在专用合同条款中明确施工项目安全生产标准化达标目标及相应事项。承包人有权拒绝发包人及监理人强令承包人违章作业、冒险施工的任何指示。Thecontractpartiesshould,duringtheexecutionofcontract,abidebytheStateandlocalauthoritys
2、requirementsofsafeworks,if,anyparticularrequirementbytheparty,theobjectandthecorrespondingissueswhichreachedbytheconstructionprojectsafetyproductionstandardizationshouldbespecifiedinparticularcondition.Thecontractorisentitledtorefuseanydirectionfromtheemployerandthesupervisorofworksagainstregulation
3、sandadventureconstruction.在施工过程中，如遇到突发的地质变动、事先未知的地下施工障碍等影响施工安全的紧急情况，承包人应及时报告监理人和发包人，发包人应当及时下令停工用艮政府有关行政管理部门采取应急措施。因安全生产需要暂停施工的，按照第7.8款暂停施工的约定执行。Duringtheconstructionprocessincaseofanyemergencymattersuchasgeologicchangeandunexpectedundergroundconstructionobstaclesandothers,thecontractorshouldreportth
4、esupervisorandtheemployerwithoutunduedelayandtheemployershouldtimelygiveordertostopworkinadditiontoreporttherelatedadministrationtotakeemergencymeasuresthereon.Providedthatthesuspensionofworkduetosafeconstruction,theperformancethereofshallbemadepursuanttoparagraph7.8(SuspensionofWork).安全生产保证措施Assura
5、nceMeasuresofSafetyConstruction承包人应当按照有关规定编制安全技术措施或者专项施工方案，建立安全生产责任制度、治安保卫制度及安全生产教育培训制度，并按安全生产法律规定及合同约定履行安全职责，如实编制工程安全生产的有关记录，接受发包人、监理人及政府安全监督部门的检查与监督。Thecontractorshould,pursuanttotherelevantprovisions,preparethemeasuresofsafetytechnologyorparticularconstructionschedules,makeestablishmentofsystemso

7、visionofadministrationauthority.特别安全生产事项ParticularItemsofSafetyConstruction承包人应按照法律规定进行施工，开工前做好安全技术交底工作，施工过程中做好各项安全防护措施。承包人为实施合同而雇用的特殊工种的人员应受过专门的培训并已取得政府有关管理机构颁发的上岗证书。Thecontractorshouldpursuanttolaw,sregulations,maketheinstructionofsafetytechnologyandeverymeasuresofsafetyprotectionintheprocessofcon
8、struction.Thepersonnelworkingontheparticulartypeofwork,whichemployedbythecontractorfortheimplementationofcontractshallbeparticularlytrainedandobtainthepostcertificateissuedbytherelevantauthority.承包人在动力设备、输电线路、地下管道、密封防震车间、易燃易爆地段以及临街交通要道附近施工时，施工开始前应向发包人和监理人提出安全防护措施，经发包人认可后实施。Wheretheconstructionsareef
9、fectedbythecontractorintheworkshopsofpowerequipment,transmissionlines,undergroundpipelinesandtheareaswhichneartrafficstreet,thecontractorshouldpriortoconstruction,submittotheemployerandthesupervisorwithhissafetyprotectionmeasuresandgettheemployer*sapprovalbeforeexecutionthereof.实施爆破作业，在放射、毒害性环境中施工(含
10、储存、运输、使用)及使用毒害性、腐蚀性物品施工时，承包人应在施工前7天以书面通知发包人和监理人，并报送相应的安全防护措施，经发包人认可后实施。Wheretheblastingoperationorworksintheenvironmentwithradiationandtoxic(includingstorage,transportationanduse)and/orconstructioninwhichusingthetoxicandcorrosivematerialsareeffected,thecontractorshouldgivetheemployerandthesupervisor

13、应：(a)complywithallapplicablesafetyregulations,遵守所有适用的安全规则，(b)takecareforthesafetyofallpersonsentitledtobeontheSite,照料有权在现场的所有人员的安全，(c)usereasonableeffortstokeeptheSiteandWorksclearofunnecessaryobstructionsoastoavoiddangertothesepersons,尽合理的努力保持现场和工程设有不需要的障碍物,以避免对这些人员造成危险，takeactionssimilartothosewhi
14、chtheContractorisrequiredtotakeundersub-paragraphs(a),(b)and(c)ofSub-Clause4.8SafetyProceduresandunderSub-Clause4.18protectionoftheEnvironment.采取与根据第4.8款安全程序(a)(b)(c)项和第4.18款环境保护要求承包商采取的类似行动。TheContractorshallatalltimesduringtheContractPeriodtakeallreasonableprecautionstomaintainthehealthandsafetyof
15、theContractor,sPersonnel.Incollaborationwithlocalhealthauthorities,theContractorshallensurethatmedicalstaff,firstaidfacilities,sickbayandambulanceserviceareavailableatalltimesattheSiteandatanyaccommodationfortheContractorDsandEmpIoyerDsPersonnel,andthatsuitablearrangementsaremadeforallnecessarywelfa
16、reandhygienerequirementsandthepreventionofepidemics.承包商应自始至终采取合理的预防措施以维护其人员的健康和安全。承包商应与当地卫生部门合作，自始至终在现场以及承包商人员和业主人员住地确保配备医务人员、急救设施、病房以及救护服务，并应做出适当安排提供所有必要的福利和卫生条件，并防止疾病的传染。TheContractorshallappointanaccidentpreventionofficerattheSite,responsibleformaintainingsafetyandprotectionagainstaccidents.Thispersonshallbequalifiedfortheirresponsibility,andshallhavetheauthoritytoissueinstructionsandtakeprotectiveme
