3、工程设计经验的专业设计院,愿意接受甲方委托承担合同所约定的工程施工图深化设计。双方经过平等协商，在真实、自愿的基础上，根据相关法律法规的规定，达成如下协议，双方共同恪守。PartyA,fortheconstructionofthenewNationalMuseumofKuwait,needstodeepenthedesignbasedontheengineeringdesigndrawingsprovidedbytheEmployertomeettheneedsofon-siteconstruction;PartyB,aprofessionaldesigninstitutewithengine
4、eringdesignqualificationsandexperienceinlarge-scaleengineeringdesign,iswillingtoacceptPartyAsentrustmenttoundertakethedeepeningofthedesignoftheengineeringdrawingsasprescribedinthiscontract.Thepartiesshall,throughequalconsultationonatrueandvoluntarybasisandinaccordancewiththeprovisionsofrelevantlawsa
5、ndregulations,reachthefollowingagreementfortheparties*jointobservancethereof.第二条对深化设计图的要求Article2Requirementsfordeepeningdesigndrawings本合同设计项目的内容：名称、规模、阶段、投资及设计费等见如下规定：Article2Thecontentsofthedesignprojectofthiscontractname,scale,stage,investmentanddesignfee,etc.areshowninthefollowingprovisions:1.根据
6、甲方的设计要求绘制本工程深化设计图。1、DrawingthedeepeningdesigndrawingsoftheprojectpursuanttoPartyA,s,designrequirements.2、乙方所绘制的深化设计图，包括相关说明、图纸目录、平面定位图、标准施工图、索引图和图表编号等。2.ThedeepeneddesigndrawingsdrawnbyPartyBincluderelevantinstructions,drawingcatalogue,planpositioningdiagram,standardconstructiondrawings,indexdrawing
7、sandchartnumbers.第四条乙方应向甲方交付的设计文件Article4DesigndocumentsdeliveredbyPartyBtoPartyA深化设计图纸提交：每批图纸乙方需提交套送审白图、一套硫酸图和一套蓝图、完整文字资料一套。所有图纸均须提供电子版图纸(光盘)，且上述图纸版权归甲方所有。图纸和文字资料提交具体时间由甲乙双方协商确定。Submissionofdeepeningdesigndrawings:PartyBshall,foreachbatchofdrawings,submitasetofwhitedrawings,asetofsulphuricaciddrawi
8、ngsandasetofblueprintsandacompletesetoftextualinformation.Alldrawingsshouldbeprovidedwithelectronicversionofdrawings(CD-ROM),andthecopyrightoftheabovedrawingsfallswithinPartyA.ThespecifictimeforsubmissionofdrawingsandtextinformationshallbedeterminedbyPartyAandBthroughconsultation.6.1.3如果甲方要求乙方在合同规定时
9、间之前交付设计资料及文件，如果乙方能够做到，甲方应根据乙方提前投入的工作量，向乙方支付赶工费。6.1.3ProvidedthatPartyArequiresPartyBtodeliverthedesigninformationanddocumentsbeforethetimespecifiedintheContractandPartyBisabletodoso,PartyAshallpayPartyBSaccelerationfeesonitspriorworkload.6.1.4甲方应保护乙方的设计方案、文件、资料图纸、数据、计算软件和专利技术。否则，乙方有权向甲方提出索赔。6.1.4Par
10、tyAshallprotectPartyB,sdesignproposals,documents,informationdrawings,data,calculationsoftwareandpatentedtechnology,otherwisePartyBshallhavetherighttoclaimagainstPartyAthereon.6.1.5甲方要求乙方派专人留驻施工现场进行配合与解决有关技术问题时，双方应另行签订补充协议或技术咨询服务合同。6.1.5WherePartyArequestsPartyBtodispatchtheassignedpersonneltostayatt
11、heconstructionsitetocooperateandsolverelatedtechnicalproblems,thepartiesshallconcludeaseparatesupplementaryagreementortechnicalconsultingservicecontract.6.1.6如果甲方要求乙方交付设计资料及文件的份数超过合同约定的份数，乙方另收工本费。6.1.6WherecopiesofthedesigninformationanddocumentsrequiredbyPartyAmorethantheprescriptionherein,PartyBwillchargeanadditionalcost.
