5、ouforyourconscientiouscomplianceandimplementation.次局务会议通过，现印发给你 们，请认真贯彻执行。市场监管总局StateAdministrationforMarketRegulationMay19,20222022年5月19日进出口商品检验机构资质认定 准入特别条件SpecialConditionsforQualificationAccreditationandAccessofImportandExportCommodityInspectionInstitutions第一条为了规范进出口 商品检验机构资质认定工作， 依照中华人民共和国计量 法及
6、其实施细则、中华人 民共和国进出口商品检验 法、中华人民共和国认证 认可条例及国务院相关规 定，制定本条件。Article1Forthepurposesofregulatingthequalificationaccreditationofimportandexportcommodityinspectioninstitutions,theseConditionsaredevelopedinaccordancewiththeMetrologyLawofthePeoplesRepublicofChinaandtheDetailedRulesfortheImplementationthereof,th
7、eLawofthePeople,sRepublicofChinaonImportandExportCommodityInspection,theRegulationofthePeoplesRepublicofChinaonCertificationandAccreditation,andrelevantprovisionsoftheStateCouncil.第二条对依法设立、从 事进出口商品检验业务的机构 （以下简称检验机构）实施资 质认定，适用本条件。第三条检验机构应当为 能够承担相应法律责任的法人 或者其他组织，应当采用职业 责任保险、风险储备金等保障 措施，以防范检验活动出现的 责任风险
8、。风险保障措施应当 与其检验活动的责任风险程度Article2TheseConditionsshallapplytothequalificationaccreditationoflegallyestablishedinstitutionsthatengageintheinspectionofimportandexportcommodities(hereinafterreferredtoas“inspectioninstitutions).Article3Aninspectioninstitutionshallbealegalpersonoranyotherorganizationthatcan
9、assumecorrespondinglegalresponsibilities,andshalladoptsafeguardmeasuressuchasprofessionalliabilityinsuranceandriskreservefundstopreventliabilityrisksarisingfrominspectionactivities.Therisksafeguardmeasuresshallbecommensuratewiththedegreeofliabilityrisksof相适宜。第四条检验机构应当对 其检验行为的公正性作出书面 承诺，不得从事检验对象的设 计、
10、生产、供应、安装、采购 或维护等活动。存在公正性影 响时，检验机构应当消除影响 或者将影响降至最低。itsinspectionactivities.Article4Aninspectioninstitutionshallmakeawrittencommitmenttotheimpartialityofitsinspection,andshallnotengageinactivitiessuchasthedesign,production,supply,installation,procurement,ormaintenanceoftheinspectiontarget.Whentheimpar
11、tialityisaffected,theinspectioninstitutionshalleliminateorminimizetheeffects.第五条检验机构应当制 定应急预案，处理检验过程中 发生的突发事件。发现被检验 对象不符合法定要求、强制性 标准要求和存在严重危害环境 或者公共安全情形时，在保证 安全的前提下，应当立即向市 场监督管理部门或者海关部门 报告。Article5Aninspectioninstitutionshalldevelopcontingencyplanstodealwithemergenciesoccurringduringaninspection.Whe
12、reitisdiscoveredthattheinspectiontargetdoesnotmeetthestatutoryrequirementsandmandatorystandardsandseriouslyharmstheenvironmentorpublicsafety,animmediatereportshallbemadetothemarketregulationdepartmentorthecustomsdepartment,providedthatsafetyisguaranteed.第六条检验机构的组织 结构和规模，应当与检验能力 相适应，检验机构应当建立和 运行与其检验活
13、动相适应的管 理体系。Article6Theorganizationalstructureandsizeofaninspectioninstitutionshallbecompatiblewithitsinspectioncapacity,andtheinspectioninstitutionshallestablishandoperateamanagementsystemcompatiblewithitsinspectionactivities.第七条检验机构应当建 立和运行对人员的管理程序。 明确不同检验项目对检验员的 要求，确保检验的公正性和独 立性。Article7Aninspecti
14、oninstitutionshallestablishandoperatepersonnelmanagementprocedures.Therequirementsofinspectorsfordifferentinspectionitemsshallbeclarifiedtoensuretheimpartialityandindependenceofinspection.检验人员应当具备与其检验活动相适应的资历、经验和培训经历。检验机构应当确保检验Aninspectorshallhavequalifications,experience,andtrainingexperiencesthata
15、recompatiblewiththeirinspectionactivities.Aninspectioninstitution员的录用、培训、考核、授 权、监督等按照程序进行，持 续对检验员的检验能力进行确 认，并保留相关记录。shallensurethattherecruitment,training,evaluation,authorization,andsupervisionofinspectorsarecarriedoutinaccordancewithprocedures,continuouslyconfirmtheinspectionabilityofinspectors,an
16、dkeeprelevantrecords.法律、法规对检验人员的资格 有特殊要求的，应当符合相关 要求。Wherelawsandregulationssetoutspecialrequirementsforthequalificationsofinspectors,theyshallmeettherelevantrequirements.第八条检验机构应当选 派熟悉检验目的、方法、程序 和结果评价的人员作为监督 员，对检验员以及其他涉及检 验活动的人员进行监督，确保 检验活动符合要求。检验机构 可以根据检验活动的特性，采 取现场观察、报告复核、面 谈、模拟检验以及其他监督方 式，上述监督方式可以组合使 用。Article8Aninspectioninstitutionshallselectpersonne
