6、esInvolvingthe（司法部）DisclosureofGovernmentInformation(Ministrj,ofJustice)Article1ForthepurposeoffurtherregulatingthetrialofadministrativereconsiderationcasesinvolvingthedisclosureofgovernmentinformationTheseGuidingOpinionsaredevelopedinaccordancewiththeAdministrativeReconsiderationLawofthePeoplesRepu
7、blicofChina,theRegulationontheImplementationoftheAdministrativeReconsiderationLawofthePeoplesRepublicofChina,theRegulationofIhePeoplesRepublicofChinaontheDisclosureofGovernmentInformation,andtheMeasuresforthe第一条为进一步规范政府信息公开行政复议案件审理工作，根据中华人民共和国行政狂议法、中华人民共和国行政复议法实施条例、中华人民共和国政府信息公开条例、政府信息公开信息处理费管理办法，结合
8、工作实际，制定本指导意见。AdministrationofInformationProcessingFeesfortheDisclosureofGovernmentInformationinlightoftheactualwork.Article 2 Whereacitizen,alegalpersonoranyotherthe law:organizationdeemsthathisoritslawfulrightsandinterestshavebeeninfringedbyanypublicdisclosureofgovernmentinformation,underanyofthefo
9、llowingcircumstances,heoritmayfileanapplicationforadministrativereconsiderationwiththeadministrativereconsiderationorganinaccordancewith第二条公民、法人或者其他组织认为政府信息公开行为侵犯其合法权益，有下列情形之一的，可以依法向行政复议机关提出行政复议申请：(1) Filinganapplicationwithanadministrativeorganforaccessinggovernmentinformationbuttheadministrativeor
10、ganrepliesthatsuchgovernmentinformationshallbewithheld(orpartiallywithheld,similarlyhereinafter),cannottobeprovided,orisnotprocessedorfailstobeprocessedwithinaspecifiedperiod.(2) Deemingthatthegovernmentinformationprovidedbyanadministrativeorganisnotthecontentrequestedbyhimorittobedisclosedtothepubl
11、ic.(3) Deemingthattheadministrativeorganinformedhimoritoftheerroneousmeans,channelandtimeforaccessingsuchgovernmentinformation.(4) Deemingthatthegovernmentinformationdisclosedtothepubliceitherproactivelyoronapplicationbyanadministrativeorganinfringesuponhisoritstradesecretsorpersonalprivacy.(5) Deem
12、ingthatotherpublicdisclosuresofgovernmentinformationbyanadministrativeorganinfringehisoritslawfulrightsandinterests.Article 3 Whenacitizen,legalpersonorotherorganizationfilesanapplicationforadministrativereconsiderationagainstthepublicdisclosureofgovernmentinformationandfallsunderanyofthefollowingci
13、rcumstances,theadministrativereconsiderationorganshallrefusetoaccepttheapplication:（一）向行政机关申请获取政府信息，行政机关答复不予公开（含部分不予公开，下同）、无法提供、不予处理或者逾期未作出处理的；（二）认为行政机关提供的政府信息不属于其申请公开的内容的：（三）认为行政机关告知获取政府信息的方式、途径或者时间错误的；（四）认为行政机关主动公开或者依申请公开的政府信息侵犯其商业秘密、个人隐私的；（五）认为行政机关的其他政府信息公开行为侵犯其合法权益的。第三条公民、法人或者其他组织对政府信息公开行为不服提出行政
14、复议申请，有下列情形之一的，行政复议机关不予受理：(1) Separatelyfilinganapplicationtoradministrativereconsiderationinrespectofsupplementsandcorrections,extensionoftheperiod,andproceduralprocessingactionstakenbytheadministrativeorgan.(2) Deemingthatthegovernmentinformationprovidedbytheadministrativeorgandoesnotmeethisoritssp
15、ecificrequirementsforpaper,seals,orthelike,ortheadministrativeorganfailstoprovidegovernmentinformationthroughspecificchannelsrequiredbyhimorit.(3) Filinganobjectiontothedecisionoftheadministrativeorganonthepaymentoffeeswithinthepaymentperiod.(4) Othercircumstancesnotmeetingtheconditionsforacceptanceofadministrativereconsideration.Article4Whereacitizen,alegalpersonoranyotherorganizationdeemsthatanadministrativeorganfailstoproactivelydisclosegovernmentinformationtothepublicandfilesanapplicationforadministrativereconsideration,theadministrativereconsiderationorganshallrefusetoacceptthea
