1、工程合同中材料与设备的条款（中英文对照）工程合同中有关材料与设备的约定（中英文对照）AGREEMENTSONMATERIA1.SANDEQUIPMENT材料与设备MaterialandEquipment发包人供应材料与工程设备MaterialandEquipmentSuppliedbyEmployer承包人采购材料与工程设备MaterialandEquipmentPurchasedbyContractor发包人自行供应材料、工程设备的，应在签订合同时在专用合同条款的附件发包人供应材料设备一览表中明确材料、工程设备的品种、规格、型号、数量、单价、质量等级和送达地点。Wheretheemploye
2、ritselfsupplymaterialsandengineeringequipmentshould,atthetimeofenteringintocontract,intheannex1.istofMaterialsandEquipmentSuppliedbyEmployer”ofparticularcondition,makestipulationofvarieties,specifications,types,quantity,priceandqualitygradeconcerningthematerialsandengineeringequipment,anddeliveryloc
3、ation.承包人应提前30天通过监理人以书面形式通知发包人供应材料与工程设备进场。承包人按照第7.2.2项施工进度计划的修订约定修订施工进度计划时，需同时提交经修订后的发包人供应材料与工程设备的进场计划。Thecontractorshould,throughthesupervisor,on30dayspriorwrittennoticetotheemployerwiththesupplyofmaterialsandengineeringequipmentwillenterintotheworksite.Thecontractorrevisetheprogressschedulepursuan
4、ttoArticle7.2.2RevisionofConstructionSchedule,andatsametimesubmittherevisedsupplyplanofmaterialsandequipmentwhicharesuppliedbytheemployer.承包人负责采购材料、工程设备的，应按照设计和有关标准要求采购，并提供产品合格证明及出厂证明，对材料、工程设备质量负责。合同约定由承包人采购的材料、工程设备,发包人不得指定生产厂家或供应商,发包人违反本款约定指定生产厂家或供应商的，承包人有权拒绝，并由发包人承担相应责任。Wherethecontractorisrespons
5、iblefortheprocurementofmaterials,engineeringequipment,thecontractorshalleffecttheprocurementpursuanttothedesignandrelevantstandard,submitcertificateofproductqualificationandcertificateofmerchandise,andliableforthequalityofmaterialandengineeringequipment.Providedthattheprocurementofmaterialsandengine
6、eringequipmenteffectedbythecontractorundercontract,theemployershallnotdesignatethemanufacturerorsupplier,ifztheemployerviolatesthisarticlehereoffordesignationofmanufacturerorsupplier,thecontractorreservetherighttorefuseandthecorrespondingresponsibilitywillbebombytheemployer.材料与工程设备的接收与拒收ReceiptandRe
7、jectionofMaterialandEquipment发包人应按发包人供应材料设备一览表约定的内容提供材料和工程设备，并向承包人提供产品合格证明及出厂证明，对其质量负责。发包人应提前24小时以书面形式通知承包人、监理人材料和工程设备到货时间，承包人负责材料和工程设备的清点、检验和接收。Theemployershould,pursuanttothecontentsstipulatedin1.istofMaterialsandEquipmentsuppliedbytheemployer,furnishmaterialsandengineeringequipmentbeingaccompanie
8、dbythecertificateofproductqualificationandcertificateofmerchandise,andberesponsibleforthequalitythereof.Theemployershould,on24hourspriorwrittennoticetothecontractorandthesupervisor,informthearrivaltimeofmaterialsandengineeringequipmentandthecontractorshallberesponsiblefortheinventory,inspectionandac
9、ceptanceofmaterialsandequipment.发包人提供的材料和工程设备的规格、数量或质量不符合合同约定的，或因发包人原因导致交货日期延误或交货地点变更等情况的，按照第16.1款发包人违约约定办理。Providedthatthespecifications,quantityorqualityofthematerialsandengineeringequipmentwhicharesuppliedbytheemployerarefoundnotinconformitywiththedescriptionsetoutincontractordelayofdeliverydateo
10、rchangeofdeliveryplaceandothermatters,willbeprocessedunderarticle16.1Employer7sBreach.承包人采购的材料和工程设备，应保证产品质量合格，承包人应在材料和工程设备到货前24小时通知监理人检验。承包人进行永久设备、材料的制造和生产的，应符合相关质量标准，并向监理人提交材料的样本以及有关资料，并应在使用该材料或工程设备之前监理人同意。Wheretheprocurementofmaterialsandengineeringequipmentiseffectedbythecontractorwhoshouldguaran
11、teethequalityoftheproducts,thecontractorshould,on24hoursbeforearrivalofmaterialsandequipment,givenoticetothesupervisorforinspectionthereof.Incasethatthecontractoreffectthemanufactureandproductionofpermanentequipment,material,thecontractorshallabidebyrelevantqualitystandards,andsubmitmaterialsamplean
12、drelevantinformationtothesupervisor,andshallacquirethesupervisorsconsentbeforeusingthematerialandequipment.承包人采购的材料和工程设备不符合设计或有关标准要求时，承包人应在监理人要求的合理期限内将不符合设计或有关标准要求的材料、工程设备运出施工现场，并重新采购符合要求的材料、工程设备，由此增加的费用和（或）延误的工期，由承包人承担。Intheeventthatthematerialsandengineeringequipmentwhicharepurchasedbythecontracto
13、rdonotmeetthedesignorrelevantstandard,thecontractorshould,withinthereasonableperiodoftimerequiredbythesupervisor,movethematerialsandengineeringequipmentwhichnotmeetthedesignorrelevantstandardfromworksite,andeffectre-procurementofthematerialandequipmentwhichareconformitywiththerequirementtheaddedexpe
14、nseand/ordelayedtermwillbebornbythecontractor.材料与工程设备的保管与使用CareandUseofMaterialandEngineeringEquipment发包人供应材料与工程设备的保管与使用CareandUseofMaterialandEngineeringEquipmentSuppliedbyEmployer发包人供应的材料和工程设备，承包人清点后由承包人妥善保管，保管费用由发包人承担，但已标价工程量清单或预算书已经列支或专用合同条款另有约定除外。因承包人原因发生丢失毁损的，由承包人负责赔偿；监理人未通知承包人清点的，承包人不负责材料和工程设
15、备的保管，由此导致丢失毁损的由发包人负责。发包人供应的材料和工程设备使用前,由承包人负责检验，检验费用由发包人承担，不合格的不得使用。Thesupplyofmaterialsandengineeringequipmentbytheemployerwillzsubsequenttomakeaninventory,besafekeptcarefullybythecontractorandtheexpenseofcareandcustodywillbebornbytheemployer,providedthatunlessotherwiseprovidedthepricedbillofquantit
16、iesorbudgetbookswiththeexpenseofsuchkindorotherstipulationinparticularcondition.Whereanylossordamageduetothecontractor1sreason,thecompensationthereofwillbeeffectedbythecontractor;ifzthesupervisorfailstonotifythecontractortocount,thecontractorisnotresponsibleforthecustodyofthematerialsandconstructionequipment,theanylossanddamagearisingtherefromwillbetheresponsibilityoftheemployer.Thematerialsandengineeringequipmentsuppliedb
