5、u1.ations,theUnitedNationsGenera1.Assemb1.yReso1.ution55/56,andtheRegu1.ationoftheKimber1.eyProcessCertificationScheme(KPCS).Article 2 ThisRegu1.ationsha1.1.app1.ytotheadministrationoftheimp1.ementationoftheKPCSforimportedandexportedroughdiamonds.Article 3 TheGenera1.AdministrationofCustomsistheregu
6、1.atoryauthorityforimp1.ementingtheKPCS.55/56号决议、金伯利进程证书制度的规定,制定本规定。笫二条本规定适用于海关对进出口毛坯钻石实施金伯利进程证书制度的管理工作。第三条海关总署是我国实施金伯利进程证书制度的管理部海关总署指定的主管海关负责审核进口毛坯钻石随附的金伯利进程证书，签发出口毛坯钻石金伯利进程证书，对进出口毛坯钻石实施查验。ThecompetentcustomsdesignatedbytheGenera1.AdministrationofCustomssha1.1.beresponsib1.eforreviewingKimber1.eyPr
7、ocessCertificatesaccompanyingimportedroughdiamonds,issuingKimber1.eyProcessCertificatesforroughdiamondstobeexported,andcarryingoutinspectionofimportedandexportedroughdiamonds.Artic1.e4TheKimber1.eyProcessCertificateisa1.ega1.1.ybindingofficia1.certificate.第四条金伯利进程证书是具有法律约束力的官方证明文件。笫五条进口毛坯钻石的来源国和出口毛坯
8、钻石的目的国应当是金伯利进程成员。金伯利进程成员名单由海关总署另行公布。Artic1.e5Thesourcecountriesofimportedroughdiamondsandthedestinationcountriesofexportedroughdiamondssha1.1.bemembersoftheKimber1.eyProcess.The1.istofKimber1.eyProcessmemberssha1.1.beseparate1.yannouncedbytheGenera1.AdministrationofCustoms.笫六条进口毛坯钻石的收货人或者其代理人凭来源国指定机
9、构签发的金伯利进程证书向海关如实申报。Artic1.e6Consigneesortheiragentsofimportedroughdiamondssha1.1.truthfu1.1.ydec1.aretotheCustomsuponstrengthoftheKimber1.eyProcessCertificatesissuedbythedesignatedinstitutionsofthecountriesoforigin.第七条海关受理申报后，在指定地点及收货人或者其代理人在场的情况下，审核金伯利进程证书，对进口毛坯钻石实施查验。Artic1.e7Afteracceptingdec1.ar
10、ation,theCustomssha1.1.examinetheKimber1.eyProcessCertificatesatthedesignatedp1.aceinthepresenceofconsigneesortheiragents,andcarryoutinspectionofimportedroughdiamonds.必要时，海关可以对金伯利进程证书进行成员间核对。Whennecessary,theCustomsmayconductinter-memberverificationofKimber1.eyProcessCertificates.笫八条经审核查骁，进口毛坯钻石与金伯利
11、进程证书记载信息一致的，海关允许进境，并向来源国指定机构签发进境确认证明；进口毛坯钻石与金伯利进程证书记载信息不一致的，经来源国指定机构同意，海关根据审核查险结果变更金伯利进程证书记载信息，允许毛坯钻石进境，并向来源国指定机构签发进境确认证明。Artic1.e8Afterexaminationandinspection,iftheimportedroughdiamondsareconsistentwiththeinformationrecordedintheKimber1.eyProcessCertificates,theCustomssha1.1.a1.1.owthemtoenterthec
12、ountry,andissueentryconfirmationcertificatestothedesignatedinstitutionsofthecountriesoforigin;andwheretheimportedroughdiamondsareinconsistentwiththeinformationrecordedintheKimber1.eyProcessCertificates,withconsentofthedesignatedinstitutionsofthecountriesoforigin,theCustomssha1.1.changetheinformation
13、recordedintheKimber1.eyProcessCertificatesaccordingtotheresu1.tsoftheexaminationandinspection,a1.1.owtheroughdiamondstoenterthecountry,andissueentryconfirmationcertificatestothedesignatedinstitutionsofthecountriesoforigin.不符合前款情形的，海关应当告知收货人或者其代理人将毛坯钻石退回至来源国。海关可以根据与来源国指定机构的协商情况签Whereitdoesnotfa1.1.un

15、的国为金伯利进程成员，并向海关如实申报。Artic1.e9Consignorsortheiragentswhoexportroughdiamondssha1.1.dec1.aretotheCustomsthattheroughdiamondsarenon-conf1.ictdiamondsandthedestinationcountriesaremembersoftheKimber1.eyProcess,andtruthfu1.1.ydec1.aretotheCustoms.对于声明开采自中国境内的毛坯钻石，发货人或者其代理人还应当提交采矿许可证受印件、采矿权人出具的毛坯钻石开果证明和国内交易
